These terms and conditions (the “Terms and Conditions”) govern the use of www.compostingnz.co.nz (the “Site”), including any and all sub-domains attached to this site, not limited to kapiti.compostingnz.co.nz; wairarapa.compostingnz.co.nz and wellington.compostingnz.co.nz.
These terms and conditions also cover purchases made in-branch at any of our retail locations.
Due to the nature of our business, we only accept refunds in very specific circumstances.
This is both to avoid contamination of our products (leaving them unfit for resale) and also to protect ourselves from unreasonable costs due to “buyer error”. We strongly encourage our customers to ensure that they thoroughly research which products are needed for their project PRIOR to buying (both for online orders and in-branch purchases).
Our friendly sales support team are happy to provide advice to customers to help them select the right soils, compost, compost-blend, mulch or aggregate product for their bespoke needs, prior to purchase.
For online orders and telephone orders, we will usually refund unfulfilled orders (orders which have not yet been loaded for delivery to your premises), although we reserve the right to apply our discretion.
Please ensure you keep your invoice for proof of purchase.
At Composting New Zealand, we pride ourselves on the quality of our products, but in the unlikely event that you are dissatisfied, please email firstname.lastname@example.org as soon as possible after receipt of purchase so that we can look into the specifics of your complaint.
When contacting us, please ensure you include the following information:
- Your name and address.
- Your order no (for online purchases).
- Your contact telephone number and email address.
- The name of the product ordered, the volume of product, as well as the branch ordered from and the date / time of order.
- Details of the issues you have encountered.
We endeavour to provide a swift and satisfactory resolution to any issues our customers report to us, within a 7 day period.
This does not affect your rights under the Consumer Guarantees Act 1993 (NZ).
We reserve the right to apply our discretion when handling requests for refunds.
No refunds will be provided without proof-of-purchase, typically in the form of a receipt or tax invoice.
Refunds will not be given where a customer has procured the wrong product for their needs. Damaged goods will need to be assessed by our on-site team.
Where we agree to provide a refund, this will be credited back in the original tender.
For online purchases, Credit Card, AfterPay and POLi refunds will be processed back via the same payment gateway.
For in-branch purchases, credit card purchases must be refunded back to the same credit card. Please ensure you provide the same card or card details to allow us to expedite any agreed refund.
In the unusual circumstance where our product has been delivered or sold on-site damaged or not fir-for-purpose, we will offer a full refund or like-for-like replacement of the defective products, pending assessment by our on-site team.
Re-collection of damaged goods
Where refunds are agreed, it may be impractical for us to remove any previously delivered product, although we will always endeavour to do so.
In these circumstances, we will usually agree to a replacement or refund as per the terms and conditions laid out above, and accept no liability for disposal of product that we are unable to retrieve due to circumstances beyond our control.

Sale of Goods
These Terms and Conditions govern the sale of goods available on our Site.

These Terms and Conditions apply to all the goods that are displayed on our Site at the time you access it. This includes all products listed as being out of stock. All information, descriptions, or images that we provide about our goods are as accurate as possible. However, we are not legally bound by such information, descriptions, or images as we cannot guarantee the accuracy of all goods we provide. You agree to purchase goods from our Site at your own risk.
We reserve the right to modify, reject or cancel your order whenever it becomes necessary. If we cancel your order and have already processed your payment, we will give you a refund equal to the amount you paid. You agree that it is your responsibility to monitor your payment method to verify receipt of any refund.
We accept the following payment methods on our Site:

When you provide us with your payment information, you authorise our use of and access to the payment gateway you have chosen to use. By providing us with your payment information, you authorise us to charge the amount due to this payment gateway.
If we believe your payment has violated any law or these Terms and Conditions, we reserve the right to cancel or reverse your transaction.
Shipping and Delivery
When you purchase goods from our Site, the goods will be delivered on a per-product delivery basis, based on postcode. Shipping costs will be displayed in full at checkout, and it is the customer’s responsibility to check this information is correct and that they agree to these costs.
You will be required to pay delivery charges in addition to the price for the goods you purchase.
Delivery will take place as soon as reasonably possible, and we will contact the customer to arrange delivery via telephone.
Delivery times may vary due to unforeseen circumstances.
You are required to provide us with a complete and accurate delivery address, including the name of the recipient. We are not liable for the delivery of your goods to the wrong address or wrong person as a result of you providing us with inaccurate or incomplete information.
Consumer Protection Law
Where any consumer protection legislation in your jurisdiction applies and cannot be excluded, these Terms and Conditions will not limit your legal rights and remedies under that legislation. These Terms and Conditions will be read subject to the mandatory provisions of that legislation. If there is a conflict between these Terms and Conditions and that legislation, the mandatory provisions of the legislation will apply.
Limitation of Liability
Composting New Zealand Ltd and our directors, officers, agents and employees will not be liable for any actions, claims, losses, damages, liabilities and expenses including legal fees from your use of the Site.
Except where prohibited by law, by using this Site you indemnify and hold harmless Composting New Zealand Ltd and our directors, officers, agents, and employees from any actions, claims, losses, damages, liabilities and expenses including legal fees arising out of your use of our Site or your violation of these Terms and Conditions.
These Terms and Conditions are governed by the laws of New Zealand.
If at any time any of the provisions set forth in these Terms and Conditions are found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed from these Terms and Conditions. All other provisions will not be affected by the removal and the rest of these Terms and Conditions will still be considered valid.
These Terms and Conditions may be amended from time to time in order to maintain compliance with the law and to reflect any changes to the way we operate our Site and the way we expect users to behave on our Site.
